Code of Conduct
Experience America is responsible for providing an environment for faculty, staff and students that is free from discrimination and harassment on the basis of categories including race, color national origin, gender, age and sexual orientation/identity. Students are in turn expected to comply with all laws, policies and regulations. Experience America may impose discipline for the commission or attempted commission (including aiding or abetting in the commission or attempted commission) of the following types of violations by students:
Note: Student conduct that occurs off University property is subject to these policies and regulations where it adversely affects the health, safety, or security of any other member of the community including students, staff, instructors, or homestay family members. In determining whether or not to exercise jurisdiction over such conduct Experience America will consider the seriousness of the alleged offense, the risk of harm involved, whether the victim(s) are members of the community and/or whether the off-campus conduct is part of a series of actions that occurred both on and off University property.
All forms of academic misconduct including but not limited to cheating, fabrication, plagiarism, facilitating academic dishonesty, consistently arriving late or skipping of classroom learning sessions without a substantiated and clearly communicated reason.
Theft of, conversion of, destruction of, or damage to any property of the University or Experience America, or any property of others, or possession of any property when the student had knowledge or reasonably should have had knowledge that it was stolen.
Violation of policies, regulations, and homestay family specific rules.
Physical abuse including but not limited to rape, sexual assault, sex offenses, and other physical assault; threats of violence; or other conduct that threatens the health or safety of any person. Sexual, racial, and other forms of harassment, defined as follows:
Harassment is defined as conduct that is so severe and/or pervasive, and objectively offensive, and that so substantially impairs a person’s access to classroom or other program activities, that the person is effectively denied equal access to resources and opportunities on the basis of the person’s race, color, national or ethnic origin, alienage, sex, religion, age, sexual orientation, gender identity, marital status, veteran status, physical or mental disability, or perceived membership in any of these classifications.
Disorderly or lewd conduct.
Unlawful manufacture, distribution, dispensing, possession, use, or sale of, or the attempted manufacture, distribution, dispensing, or sale of controlled substances, identified in federal and state law or regulations.
Manufacture, distribution, dispensing, possession, use, or sale of, or the attempted manufacture, distribution, dispensing, or sale of alcohol that is unlawful or otherwise prohibited by, or not in compliance with, Experience America policy or University regulations.
Where the actor means to communicate a serious expression of intent to harass, or acts in reckless disregard of the risk of harassment, one or more students, faculty, staff, or homestay family member. Harassment means to cause a reasonable person to fear or experience emotional and/or physical harm, perpetrated by the actor or those acting under the actor’s control. ‘Reckless disregard’ means consciously disregarding a substantial risk. This section applies without regard to whether the conduct is motivated by race, ethnicity, personal animosity, or other reasons. This policy is all encompassing for all different medians of harassment including verbal, written or digital.
Experience America has the specific responsibility for providing prompt and effective responses to all complaints of sex discrimination or harassment for faculty, staff and students. The Office also responds to concerns from faculty and students regarding other forms of discrimination such as, age, religion, national origin, etc. Any member of the faculty or staff, a student or any other person may file a complaint. Complaints may be filed online at (website) or communicated in person to any Experience American staff member who is responsible for official documentation of the matter.
Experience America is responsible for intake of complaints alleging violations of the policies and regulations, investigation of alleged violations, issuing charges of policy and regulations violations, participating in the informal resolution process, and presentation of conduct violation cases. Each case is handled individually and, while due process is always provided, every procedure outlined in the following section may not be used in a particular case.
When a student is found in violation of these policies and regulations, any of the following sanctions or combination thereof may be imposed. The decision to impose any sanction is determined solely by Experience America. Any decision is final and not reviewable. Any sanction imposed should be appropriate to the violation, taking into consideration the context, previous violations, and seriousness of the violation.
Written notice (reportable) or reprimand (non-reportable) to the student that a violation of specified Experience America policies or regulations has occurred and that continued or repeated violations of Experience America policies or regulations may be cause for further disciplinary action. A warning may be issued in instances of deliberate and serious violations as well as for repeat, non-egregious violations.
Loss of Privileges and Exclusion from Activities
Exclusion from participation in designated privileges and activities for a specified period of time. A Notice of Loss of Privileges will be emailed to the student identifying those sections of the policies or regulations the student is charged with violating and includes a detailed description of the facts supporting the charges. Violation of any conditions in the written Notice of Loss of Privileges, or violation of Experience America policies or regulations during the period of the sanction may be cause for further disciplinary action, normally in the form of dismissal.
A requirement for restitution in the form of reimbursement may be imposed for expenses incurred by Experience America or other parties resulting from a violation of these policies. Such reimbursement may take the form of monetary payment or appropriate service to repair or otherwise compensate for damages. Restitution may be imposed on any student who alone, or through group or concerted activities, participates in causing the damages or costs.
Termination of a student from the program. Dismissal will typically be used in cases that cannot be appropriately addressed with warnings or loss of privileges because the recurring nature of multiple violations or the extraordinary caliber of a single violation demonstrates that the student does not deserve an opportunity to return to the program. Though discussed with instructors and school administrators, Experience American reserves the right to make the final decision as to student dismissal from the program, and a Notice of Intent to Dismiss will be sent via email to the charged student. Readmission after dismissal may be granted only under exceptional circumstances. Any student dismissed shall not be entitled to any refund of monies paid for the program and may incur additional expenses.
Activity Release of Liability
The “Eastside Catholic Spring Break” program includes all services provided as a part of the comprehensive program: Education, Room/Board, Activities, Transportation, Meals, and all other services. Activities may include tours in and around Los Angeles or New York, and recreational activities organized by Experience US LLC (“Experience America”), of 4556 University Way NE #200 Seattle, WA 98105 and/or use of the property, facilities and services of Experience America. In exchange for participation in the “Eastside Catholic Spring Break” I agree for myself and (if applicable) for the members of my family, to the following:
I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Experience America, or the employees, representatives or agents of Experience America.
I recognize that there are certain inherent risks associated with the above described activity and, as lawful consideration for being able to participate in the Program, I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Experience America, its agents, officers, directors, and employees for injury, loss or damage arising out of my or my family’s use of or presence upon the facilities of Experience America, whether caused by the fault of myself, my family, Experience America or other third parties.
I agree to indemnify and defend Experience America against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family’s use of or presence upon the facilities of Experience America.
I agree to pay for all damages to the facilities of Experience America caused by my or my family’s negligent, reckless, or willful actions.
Any legal or equitable claim that may arise from participation in the above shall be resolved under Washington law.
By agreeing to the terms and conditions you are indicating that you have read and fully understood the policies stated above, and agree to voluntarily surrender any legal rights which do not abide by them.
Loss or Damage to Experience America Property
As a part of the “Eastside Catholic Spring Break” program students will receive a personal smartphone/SIM card and metro transit bus pass. You are personally responsible for this property. If a student loses or damages the smartphone they will be personally responsible to reimburse Experience America for the cost of the cell phone, $300 USD. If students lose their bus pass and/or meal card they will be responsible to pay for their own transportation and meals. Experience America will replace these items upon reimbursement.
By agreeing to the terms and conditions you are agreeing to abide by the above stated property rules.
Student Homestay Obligations and Waiver
By agreeing to the terms and conditions you are entering into a contract with your host family directly. American Family Homestay LLC dba “Experience America Homestay” is a reservation agent that connects students with accommodation providers “Host Families.”
Students should keep their bedroom clean, neat and tidy and assist with minor household chores. Students should Clean up after yourself in all areas of the home and remain considerate to your host’s household and keep noise to a minimum. Students should behave courteously in the host family home and communicate in a respectful way. Students should also take responsibility for their own basic needs.
Abide by the specific household rules agreed upon in your Student-Host homestay orientation with your family.
Students should prepare their own breakfast unless one is provided by the family. If you want to buy extra food of your own, you should speak to your family to reserve some space to store it.
You are responsible for your own transportation to and from school.
If there are any damages caused, you are obligated to pay for any damage you cause to host property.
Be aware and respectful of the cultural beliefs of the host and their family. Understand that hosts come from a variety of cultural backgrounds that cultural differences are not considered an acceptable basis for rejecting a homestay placement.
Be aware of and abide by Federal and State Laws (for example, wear bicycle helmets, respect legal age of drinking, wear seat belts, etc.) Ask permission of your host before taking alcohol into their home (no one under 21 years of age should ever be in possession of alcohol).
Ask permission of your host before inviting friends to their home and do not have any overnight guests.
Advise your Experience America Homestay coordinator immediately of any concerns regarding your health or welfare Direct Financial Transactions: Direct financial transactions associated with accommodations between the student and the host is strictly prohibited. Experience America Homestay will terminate its relationship with any host that violates this policy.
Authorization for Medical Treatment
Hospitals and physicians may be reluctant to treat or care for children without consent from parents or legal guardians. This can cause problems if the child has a medical emergency and parents/guardians are not readily available to consent to treatment

– obtain medical treatment and procedures for the child as may be appropriate in emergency circumstances, including treatment by physicians, hospital and clinic personnel, and other appropriate health care providers.
– obtain routine medical treatment from appropriate health care providers if symptoms of illness occur (e.g., fever, coughing, irregular breathing, unusual rashes, swallowing problems, etc.).

This grant of temporary authority shall begin when Experience America takes custody of the student, and shall remain effective through the student departing from the program.
In case of an emergency, the care provider(s) should first try to contact the parent(s). If the parent(s) cannot be reached, the care provider should then contact the following person(s) in the order listed below:
Student agrees to INDEMNIFY, DEFEND and HOLD HARMLESS American Family Homestay LLC “Experience America Homestay” and Experience America, its agents, officers, directors and employees, from and against any and all current and future claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought against Experience America as a result of any issue related or associated with the Homestay or the Student, including but not limited to the loss of property, personal injury, illness, accident or death sustained by the Student or any guest thereof, or any member of the Homestay Family or guests thereof incurred as a result of any action taken by the student.
Although Experience America Homestay introduces the parties, and may assist in facilitating a contract between the Student and the Homestay Family, any agreement for a Homestay or related services shall be between the Student and the Homestay Family and shall not be between either party and Experience America Homestay is not liable to either party in regards to the obligations of any Homestay housing or lodging agreement or related services. Accordingly, The Student agrees to INDEMNIFY, DEFEND and HOLD HARMLESS Experience America Homestay from and against any and all current and future claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought against Experience America Homestay as a result of any issue or any dispute between the Homestay Family and Student, or any related or associated individual.
PARENT/GUARDIAN AUTHORIZATION FOR A MINOR
By signing and agreeing to all terms and conditions presented in this contract:

I acknowledge that I have read its contents and warning, that I understand its contents and warning, and that I agree to its terms.
As an underage student, Experience America has permission to contact my parents/guardian at any time with concerns they may have in regards to academic or personal matters.
